if I file a SNAD and ebay decides the outcome, can I ignore it?
I bought a lot of clothing recently. Seller mentioned that there were no marks on the items except for one small mark on the inside of one the items. The items came and 80% of the items had spots/stains that were immediately noticable on the fronts. I contacted the seller within 15 minutes of opening the package to mention this. Seller says I can send it all back for a refund. I ask for clarification if that includes covering the return shipping since the items are not as described and offer to send pictures. I know it is not policy to require that, but I feel a good seller would be willing to do that in a case of their error, especially when it can be proven. I send the pictures a couple of hours later, seller says I can return the items, but will not cover return shipping. I send a message back mentioning that I do not feel it is right that I must be out $ when the seller is the one in error (didn't use exactly that wording). I suggested a partial refund instead that I felt was more fair for the seller (it was less then I truly would have liked, but would have covered the shipping, ebay, and paypal fees for the seller, with a little left over, so I felt it was more than fair). Seller says I can return it now only for the original purchase price and that they are being nice since their auction says no returns and since the ad says that there were no marks that the seller could see (so that means if they don't look closely it's OK????). These clothes are not that light and it is not worth the $ or hassle to me to send them back. I have now tried to wash them and there are still stains. At least there is one unmarred item, but it alone is not worth what I paid! The rest end up being expensive never leaving the house clothes. Can I file a SNAD in hopes that I can still possibly get a partial refund? If I file a SNAD and in the end ebay rules that I can return it and be refunded pp + original S&H, do I have to?||||||If 80% of the items have spots & stains on the front of them, why would you want to keep them?? Either the items are usable or they are not! Why would you want a partial refund. I understand why many sellers wont do partials. They think if you are truly unhappy with your purchase, you will return for full refund. IMHO...partial refunds are for scammers!! Those who just want to renegotiate the price after the fact. Stop playing games and decide one way or the other. Keep them or send them back for full refund.|||These clothes are not that light and it is not worth the $ or hassle to me to send them back. The seller is the one in error, not me. This is not buyers remorse. This is item not as described. I don't get the option of returning the 80% and keeping the 20%. At least with a parital refund, I am out more than I would like or think is truly fair but at least have a little something to show for it.||||||Wait to leave feedback until you've tried to work this out with the seller.|||||||||You've asked the seller for return shipping and been turned down. You can ask again but i wouldn't hold my breath. Are you thinking of using the dispute as "leverage"? But what redbud was saying was that once you've washed them, (and if you've admitted that to the seller) then technically you're not allowed to file a SNAD.~James~|||"file SNAD even if you don't intend to send it back", which is why I posted my question before I went that route. In other words, you are really wanting to get your money back & keep the items. You have it in your head that other people have been told by eBay to keep the item, while getting a full refund, so why not try your hand at it! This is one for the BBL!!!||||||||||||
