Short an item--What now?

Long time ebay buyer first time poster. I made a multiple buy it now purchase from an established seller 5/31/10 and paid via pay pal. The package arrived 6/14/10 it was short one item. I contacted the seller the same day and he responded that he was sorry and would send the missing item. I sent him a message on the 24th asking for an update but nothing, This morning I again sent him a message saying that If I haven't herd from him by tomorrow I would contact ebay. My question is do I go for buyers resolution or what?|||I would open up a resolution claim. He may have truly forgotten to send it, give him the benefit of the doubt if his feedback is good. (If it isn't, well, that's another can of worms) Go to "my ebay", click on the left on "won". On the list of items, find the one you're looking for, and on the right click "more actions" "resolve a problem" Then just follow the steps. The resolution will get everything in timely and you will either get your item or get a refund. Good Luck!|||And by the way -- you need to file for Significantly Not As Described, and NOT for Item Not Received.||||||If you file for item not received, when the seller gives eBay the delivery confirmation number, they will check, see the package was delivered and deny your claim.~ Lucy ~ Guide to eBay Board AcronymsClick on for links to Help Pages for a new eBayer|||Or would that indicate that the entire order had gone astray? YesIt may not be your fault but it is your responsibility Silver rule "do not do to others what you would not like to be done to you"|||I'm in a similar situation and I understand the reason for not filing INR. But if I (and this poster) file SNAD, will we have to return all items to receive a refund? (I received one of three, then seller said she would ship the second and refund the third, so I've already had a partial refund, but I'm still "down by a third."|||Yes usually you must return what you did get for a refund of your full payment. It may not be your fault but it is your responsibility Silver rule "do not do to others what you would not like to be done to you"|||you only have 45 days to file a SNAD, would not wait to much longer.|||I filed today. Maybe it will get some results.|||Got results. A hollow promise of delivery no later than Mon. July 12. Nothing showed up Mon. Tue. or Wed. Escalated claim thru ebay. I will post up dates as I get them from ebay.|||Fast action by ebay. I got a refund for $10.84 and this comment: Final decision: Neither you or the seller were found at the fault. Your message to eBay Customer Support: "Seller emailed (check the entire email chain) that the missing item would be delivered no later than Monday 7/12/10. No item. No contact. Twice he has said that he would send the item but has failed to deliver. I am tired of this. He should treat his customers with the same respect that he would expect receive from others. If he has misplaced the item fine tell me. Don't tell me that he will do something then let it slide. This is by far the worst buying experience I have had over my years with the ebay community. I really wanted the item but that is probably out of the question. At this point just getting my $9.99 refunded is all I can hope for. Let him keep the postage as it was a combined shipment. By the way is there a way I can block sellers in a search?" What kind of feed back should I leave?
