More than 10 available but really wasnt...

Here is my scenario: 1. A listing for replacement parts as buy it now showing more than 10 available. 25 bucks.. 2. Do the buy it now thing and pay with paypal as usual. 3. less than 10 minutes later I get the confirmation of payment from seller. 4. 9 days later I send email to seller and ask it item has shipped. Return email advised me that item is on backorder and is expected at any time. BACKORDER???? The listing showed more than 10 available. Hmmmmmm... 5. Send another email to seller and mention the sellers page showed more than 10 available, as there were more listings from other sellers for the same part for roughly the same price. And to let me know when or if it is shipped. 6.Next morning I receive email that item has been shipped... with tracking USPS number. Tracking the number today still shows as pending. Hopefully I will still receive item. However even if I do... is there something wrong about saying more than 10 available when it isn't? Then NOT communicating with the buyer at all until the buyer requests information and THEN tells buyer it is on backorder? I would assume a very negative feedback is in order at the very least... Anyway, thanks for any advise someone may send my way..|||Sellers should have the item on hand, but sellers are also within policy to drop ship, which means they don't have the item at their location, but place their order when you buy and pay. " It is against the Ebay Selling Practices Policy (availability) Link Report it to Ebay from the Selling Practices policy page (upper right hand corner "Contact Us". It will put the Drop Shipper seller on Ebay's radar If you do not receive the item within 10 bus days after receiving the delivery confirmation number , file the INR (Item Not Received) with either Ebay OR Paypal. Once the seller realized the item was "out of stock" they should have communuicated (your choice) waiting for restock or an immediate full refund. Leave Appropriate low DSR stars for poor communication and a Neg as follows: Example: " Item out of stock, took _____days for item to finally arrive after payment. Buyers Beware."
